SW2012 Section 1.A EULA refers to the use of a dongle for network users. Yet they offer no dongle.

We are being asked to "accept" a lie.
If I remember correctly from when I was in the reseller channel they went away from the dongle completely and started using the license file approach on all network installations. It could just be the EULA is out of date and needs to be updated.
Rebecca, you are correct that Solidworks no longer uses a USB dongle to authorize network license servers. That went into effect in the 2011 release I believe. The inclusion in the language of the EULA is probably an oversight on their part and not a part of a deliberate attempt to place anyone in non-compliance. However, bravo, you were paying attention and ostensibly tripped them up. Good job, sleuthing that.
Now, if this is anything more than an academic exercize I suggest the following:
Call Solidworks licensing and ask for an adendum to the agreement and allowances for an extension on the refund period until such time as you have the opportunity to review and accept the amended agreement.
My first response to this issue was January 24, 2012, here we are almost a year later and 2013 EULA still refers to the use of a dongle. All my patience has been exhausted. I've tried several angles but still no change. I cannot install 2013 without this change.
I would take the position that the process of activiation is a virtual dongle. Does the EULA define the form the dongle must take, be it a physical piece of hardware or virtual through activation?
Rebecca, looking at the post history in you profile, I was not able to locate your January 24, 2012 post. What actions have you taken in order to get an ammended license agreement? Did you contact Solidworks licensing? There's a 1-800 number in the media kit that you can call. If nothing else, try contacting your reseller to see if they can get in touch with Solidworks.
