Need some help here. I hopefully am not getting myself into
trouble here but I dont exactly know the rules on this and have
seen a few posts but still doesnt make sense..
My company has 2 seats of solidworks. We just got 2008 last week so I took it home first to make sure it was going to be a smooth transition. Now I thought I was allowed to install it on another computer if its less than 20% usage, which it is, I barely have to work from home. Anyways, it said unable to activate this license has already exceeded it seats 0/3 or something to that effect. Does that mean that someone else is using our cd key?!?
Any help appreciated...

If not, SolidWorks technical support can help, if you've paid your subscription service. At least, that's my understanding of things.
I hear there have been some issues with folks who use a SolidNetWork license at the Office. Home installations are not activating properly and a Home Use License may neet be requested, for which a Home Use License Serial Number would be generated.
At last I was aware, Home Use License does not enable ugrading Service Packs, so you'll be stuck at whatever Service Pack your install media is.
what i'm going to do now is burn the source files for sw08sp3.1 and bring it home and try to install it with the home license.
